  1. ConfigSafe SOFTWARE LICENSE AGREEMENT

  4. 1. LICENSE  imagine LAN, Inc. (the "Licensor") hereby grants 
  5. to you a nonexclusive license to use ConfigSafe software.
  6. ConfigSafe software is licensed per system.  A license
  7. must be purchased for each system on which you install ConfigSafe
  8. software (with the exception of ConfigSafe Preload Client and
  9. ConfigSafe Support Edition, which are provided by PC vendors). You 
  10. agree that you will not assign, sublicense, transfer, pledge, lease,
  11. rent, or share your rights under this License Agreement. You 
  12. agree that you may not reverse assemble, reverse compile, or
  13. otherwise translate the Software. No copies of the Software or
  14. any portions thereof may be made by you or any person under your
  15. authority. You acknowledge that ConfigSafe software is a
  16. proprietary product of Licensor protected under U.S. and
  17. international copyright laws.

  19. 2. TERM  This License Agreement is effective upon your opening 
  20. of this packet, or selcting the "Agree" button upon installation,
  21. or receiving ConfigSafe Preload Client or ConfigSafe Support Edition
  22. as preload software on your system, and shall continue until
  23. terminated. You may terminate this License Agreement at any time
  24. by returning the ConfigSafe software and all copies thereof to
  25. Licensor. Licensor may terminate this License Agreement upon the
  26. breach by you of any term hereof. Upon such termination by Licensor,
  27. you agree to return to Licensor the ConfigSafe software and all
  28. copies and portions thereof.

  30. 3. LIMITED WARRANTY  With the exception of ConfigSafe Preload Client,
  31. ConfigSafe Support Edition, and ConfigSafe demo software, Licensor
  32. warrants for a period of 30 days from the date of commencement of
  33. this License Agreement (referred to as the "Warranty Period") that
  34. the diskette in which the ConfigSafe software is contained is free 
  35. from defects in material and workmanship. If during the Warranty 
  36. Period, a defect in the diskette appears, you may return the diskette
  37. to Licensor for either replacement or, if so elected by Licensor,
  38. refund of amounts paid by you under this License Agreement. You agree
  39. that the foregoing constitutes your sole and exclusive remedy for
  40. breach by Licensor of any warranties made under this Agreement. 
  41. EXCEPT FOR THE WARRANTIES SET FORTH ABOVE, THE SOFTWARE, IS LICENSED
  42. "AS IS," AND LICENSOR DISCLAIMS ANY AND ALL OTHER WARRANTIES, WHETHER
  43. EXPRESS OR IMPLIED, INCLUDING, WITHOUT LIMITATION, ANY IMPLIED 
  44. WARRANTIES OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE.

  46. 4. LIMITATION OF LIABILITY  Licensor's cumulative liability 
  47. to you or any other party for any loss or damages resulting from 
  48. any claims, demands, or actions arising out of or relating to this 
  49. Agreement shall not exceed the license fee paid to Licensor for the 
  50. use of the Software. In no event shall Licensor be liable for any 
  51. indirect, incidental, consequential, special, or exemplary damages 
  52. or lost profits, even if Licensor has been advised of the possibility 
  53. of such damages. SOME STATES DO NOT ALLOW THE LIMITATION OR 
  54. EXCLUSION OF LIABILITY FOR INCIDENTAL OR CONSEQUENTIAL 
  55. DAMAGES, SO THE ABOVE LIMITATION OR EXCLUSION MAY NOT 
  56. APPLY TO YOU.

  58. 5. SUPPORT  Support for ConfigSafe Preload Client and ConfigSafe
  59. Support Edition is provided by the PC Vendor.  Support for all
  60. other ConfigSafe software products is provided (via email) to
  61. registered ConfigSafe customers by imagine LAN, Inc.  Please email

  64. This License Agreement is governed by the laws of the State of 
  65. New Hampshire, USA.
